Anniston files suit
to seek control of McClellan
While the current
Anniston mayor and city council has voted to file a suit in federal
court to seek control of McClellan, that consensus is likely to
change when a new city council takes office next month. The city
filed suit Monday in federal court citing among other things that
despite the Alabama legislatures action in the 90’s to give the
McClellan redevelopment responsibility to Calhoun County, Circuit
Judge Joel Laird did not have jurisdiction to dissolve the JPA.
Anniston’s Mayor elect and two newly elected council members will
hold a press conference this afternoon to clarify their position on
the lawsuit and their course of action once they take office.
Calhoun county commission chairman Eli Henderson said Tuesday that
he feels the latest action by the city of Anniston could jeopardize
cleanup operations at McClellan. The suit names Calhoun County, the
county commission and others as defendants. Henderson said the
county will not fight the suit. The city has asked the federal
courts to stop the transfer of property or cleanup money to the
county pending a ruling on the suit.
Ruling issued in
Anniston Ward 2
Calhoun County Circuit Judge John
Thomason issued his ruling Wednesday in an election challenge filed
against Anniston Ward 2 council candid David Reddick. Jerome
Freeman had filed the action after Reddick had failed to file his
statement of appointment of principal campaign committee which was
required within 5 days after he became a candidate. Ironically,
Reddick’s opponent, Herbert Palmore had faced a challenge on the
same allegations filed in a challenge which was thrown out because
the challenge was not filed prior to the election results being
certified declaring Palmore the winner. Judge Thomason, while not
ordering Reddick’s name removed from the ballot ordered that Reddick
is ineligible to receive and may not be issued a certificate of
election, however Reddick has been given until October 30th
to appeal the decision.
arrested on sodomy charges
A 53 year old Ohatchee man, charged
last month with two counts of sodomy involving two minors between
the ages of 12 and 14, is now facing additional criminal charges.
According to Lt. Richard Smith, commander of the Calhoun Cleburne
county drug and violent crime task force, Joseph Stephen West was
arrested Tuesday. Investigators executed a search warrant at West’s
business, Custom Insurance in oxford where they recovered documents
related to the charges. West is currently being held in the Calhoun
county jail without bond.
